1. General regulations
1.1 The Patent License Sector is an independent scientific technical structural subsection in SRD in the University. The Sector is headed by the Director of the Sector who reports directly to the Director of SRD.
1.2 The activity of the Sector is regulated by the Constitution of Ukraine, laws and by-laws dealing with the questions of intellectual property; by the orders of the MESU, the University authority and this Regulation.
1.3 The Sector cooperates with the appropriate subsections of the University; maintains the professional contacts with the organizations working in the sphere of the intellectual property protection.
1.4 The staff of the Sector is certified by the Rector of the University according to the contingent of employees performing the scientific research works. The Sector activity is financed at the expense of the Ukrainian national budget for carrying out the scientific researches.
1.5 The Patent License Sector is staffed by the employees that have higher education and are the specialists in patent science.
1.6 The staff of the Sector:
- the patent engineer of the first category;
- the technician of the first category.
1.7 The Sector is provided with the separate room, required modern office equipment and normative methodological materials.
2. The tasks of the Sector
The main task of the Patent License Sector is the scientific technical and organization methodological support of the researches according to the University patent legal protection of the intellectual property.
3. The functions of the Patent License Sector
3.1To participate in the annual provisional expenses preparation for the patent license activity of the University.
3.2 To participate in the technical tasks developing for the scientific research and research design performing.
3.3 To provide with organization methodological materials and to participate in the patent research performing in scientific research and research design work according to the Ukrainian State Standard - 3575-97 “Patent researches” and the Ukrainian State Standard - 3574-94 “Patent account”.
3.4 To analyze the patentable results of scientific research and research design work. To coordinate the problem dealing with the procedure of its patenting.
3.5 To prepare and give requests to the Ukrainian Patent Agency for getting patents for inventions, useful patterns, process samples, marks for products and services and other objects of industrial property.
3.6 To prepare the reasoned objections (answers, statements, explanations, etc.) to the decision of the Ukrainian Patent Agency;
3.7 To prepare the propositions about the suitability of the received patents for inventions, useful patterns, process samples. To control the timely pay for dues and tax collection.
3.8 To perform a work package dealing with the patenting inventions and other objects of industrial property in foreign countries.
3.9 To participate in projects of license contracts and contracts about the deviation from patent rights together with the scientific research and research design work performing subsections.
3.10 To participate in making contracts between the inventors and the University about premium payments and other kinds of encouragement for usage of office inventions, useful patterns, process samples.
3.11 To participate in examination of the materials that are ready for being published, exhibited etc.
3.12 To organize the reviews – the invention competitions.
3.13 To consult every interested persons among the employees, postgraduates, students of the University on the patent legal questions.
3.14 To participate in the scientific research and educative work dealing with the intellectual property and patent science particularly.
3.15 To form and support in good order the archive of the application documents and received patents.
3.16 To form and support in good order the reference search apparatus and the fund of instruction methodological literature.
3.17 To fill up the database “The Inventions of NUS”.
3.18 To perform the printing and other technical work.
3.19 To keep primary accounting of the work executed. To prepare the reporting, state statistical reporting particularly, on performance of the patent license activity both of the University in general and separate subsections and individuals.
3.20 To prepare the propositions about improvement of the inventive and patent license activity in the University.
4. The rules of the Patent License Sector
PLS has a right to:
4.1 Get from the Scientific Research Department direction all the necessary for its functioning documents and information.
4.2 Involve appropriately the workers of the structural subsections of the University in the performing the patent license works.
4.3 Give the propositions dealing with moral and material encouragement of the inventors and people favouring the inventive act in the University to the direction.
